Congressional Co-Sponsors Are Needed for ADA’s ERISA Legislation
Because of ADA’s Lobby Day, some co-sponsors have been successfully secured to sponsor H.R. 7931, the Improving Dental Administration (IDA) Act, which would ensure that state dental insurance consumer and patient protection laws apply to patients covered by employer self-funded dental plans, as well as fully insured plans.
What does that mean? It means the loophole for Assignment of Benefit and Non-Covered Services laws that some insurers in WV say they don’t have to follow would be CLOSED!
While this early bi-partisan support is a great start, the ADA and WVDA need your help in securing more Representatives as cosponsors of this critical legislation. Without their support, Congress will not take action to stop dental carriers and administrators from chronically side-stepping state insurance laws under the veil of ERISA preemption.
Through H.R. 7931, we can close the ERISA loophole and finally bring consistency and accountability to federally regulated dental plans. All you patients deserve to be treated equally under the law when receiving dental care, no matter how their dental benefit plan is designed.
